GENERAL TERMS AND CONDITIONS OF SALE - GTC
1- GENERAL:
These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all the services offered by "Alexandra Massages Energisants", a micro-enterprise registered by MICELI Alexandra ( E I ) under SIRET number 92801814200010, and this, to all of its clients, regardless of their status or quality. Consequently, the placing of an order by a client for the provision of a service offered at home, either by phone at 07 55 66 23 96, or on the website: www.alexandramassagesenergisants.fr carries with it their membership and acceptance, without reservation, to these GTC unless otherwise agreed in writing beforehand by the parties.
The sale will only be perfect after express acceptance by any written means of the order by
«Alexandra Energising Massages».
«Alexandra Massages Energisants» reserves the right to modify these GCS at any time, it being specified that the modifications will only be applicable to orders placed following the entry into force of such modifications.
Any other document than these GTCS, in particular advertisements, flyers... has only an informative value of the activity proposed by «Alexandra Massages Energisants» and is non-contractual.
2- DEFINITIONS:
The services offered are those listed on the website «Alexandra Massages Energisants»
and at home namely:
The services of Massages; Shiatsu; Acupuncture; Geobiology; Energy cleaning at the session.
The reservation for these services mentioned above.
The Client is the person who books a session or product at «Alexandra Massages Energisants».
3- CONDITIONS FOR CARRYING OUT THE SERVICES:
Regarding Wellness Massages:
The purpose of the activity of "Alexandra Energy Massages" carried out by Alexandra MICELI is exclusively the well-being of the person. In accordance with the legislation in force, the Wellness Massages practiced by Alexandra MICELI are in no way similar in content or purpose to the practice of Physiotherapy, as well as any medical and/or veterinary practice.
These are manual well-being and relaxation techniques only. Are also excluded from the activity of «Alexandra Massages Energisants», all services of an erotic or sexual nature.
«Alexandra Massages Energisants» only intervenes by appointment at home, in the areas noted in the "reception" section.
The trips to the client’s home, in a professional environment, in a school or leisure environment, in healthcare establishments (hospitals, clinics, retirement homes...), or in any place open to the public (event executives, trade shows, congresses...) are made in the city of VAISON-LA-ROMAINE & surroundings.
The services are offered from Monday to Saturday according to the hours indicated on the GOOGLE Alexandra Massages Energisers page. MICELI Alexandra reserves the right to modify schedules at any time.
During the Wellness Massage sessions, «Alexandra Massages Energisants» provides the client with all the necessary professional equipment (massage table or chair, protective linen, towels, massage oils, accompanying music, hygienic products,...) and reserves the right to refuse a Wellness Massage session in case of questionable hygiene on the part of the client.
The session begins with a questionnaire that will together take stock of the client’s condition and needs in order to determine the most suitable massage. A time will be left for the client to settle in. The client has the obligation to keep their underwear during any wellness session; and any service.
After checking that the client is properly installed, the session can start. The comfort and modesty of the client will be ensured by a set of sheets and towels.
At the end of the massage, a time will be left for the client to come to his senses and get dressed again. A point will be made about mutual feelings and some advice will be given.
The sessions include support, installation, massage, and the final debrief.
4- CONTRAINDICATIONS TO WELL-BEING MASSAGES
When practiced by a qualified professional, the Wellness Massage is generally risk-free and rather beneficial. However, in case of illness or doubt, it is recommended that the client seek medical advice. Indeed, there are total, local or temporary contraindications to massage. Some treatments require precautions to be taken by «Alexandra Massages Energisants».
In all cases, areas with varicose veins, burns, open wounds or any sign of inflammation or local infection will not be massaged.
Contraindications to massage:
– Feverous, infectious or contagious state
– Hemophilia
– Phlebitis: Blood clot formation in a vein. Symptoms: pain, heaviness, swelling of a limb.
– Severe high blood pressure if not effectively treated
– Acute pain, inflammation or injury
– Surgical operation less than 3 months
– Pregnancy
Some precautions:
– Cancer, heart disorders, any systemic, chronic or autoimmune disease: A written medical opinion specifying the precautions to be taken is mandatory.
– Allergy, anticoagulant treatment and breastfeeding.
THE CONTRAINDICATIONS TO TRADITIONAL JAPANESE SHIATSU
When practiced by a qualified professional, traditional Japanese Shiatsu is generally risk-free and rather beneficial. However, in case of illness or doubt, it is recommended that the client seek medical advice. Indeed, there are total, local or temporary contraindications to Shiatsu. Some treatments require precautions to be taken by «Alexandra Massages Energisants».
In all cases, areas with varicose veins, burns, open wounds or any signs of inflammation or local infection will not be acupressed.
Contraindications to Shiatsu:
– Feverous, infectious or contagious state
– Phlebitis: Blood clot formation in a vein. Symptoms: pain, heaviness, swelling of a limb.
– Acute pain, inflammation or injury
– Surgical operation less than 3 months
- Brittle bone disease
Some precautions:
– Cancer, heart disorders, any systemic, chronic or autoimmune disease: A written medical opinion specifying the precautions to be taken is mandatory.
To ensure that his client is able to receive a wellness service (massage; shiatsu; acupuncture), an interview will be set up from the first appointment. The client declares to inform «Alexandra Massages Energisants» in advance of any changes in their health during future appointments.
Consequently, "Alexandra Massages Energisants" reserves the right to refuse at any time a client whose state of health would not be compatible with the performance of a Wellness service on his person without prior medical advice.
5- FINANCIAL CONDITIONS
The prices of the services offered are indicated in euros on the website www.alexandramassagesenergisants.
«Alexandra Massages Energisants» is not subject to Value Added Tax (VAT) in accordance with article 293B of the General Tax Code, the prices mentioned on the website are therefore indicated without VAT. In the event that «Alexandra Massages Energisants» becomes subject to VAT, the rates displayed on the site will be adjusted accordingly and applicable to any order placed following the date of its imposition.
«Alexandra Massages Energisants» also reserves the right to modify its rates at any time, it being specified that the services will be charged on the basis of the rates in effect at the time of booking the appointment.
6- THE MAKING OF APPOINTMENTS AND THE MODIFICATION OR CANCELLATION OF A RESERVATION
6-1- Making an appointment:
It is carried out on the website or by phone. All the necessary contact details for making appointments are available on the website www.alexandramassagesenergisants.fr.
Online booking is open only for home reservations. For sessions in equestrian centers or companies, the reservation is made by phone.
To book online, the booking form must be completed by following each step. The client chooses the desired service, the duration and its availability. Depending on the defined criteria, time slots will be proposed to him. Only the slots available for the duration of this service are displayed.
«Alexandra Massages Energisants» reserves the right to contact the client to change the time of the appointment if necessary.
The client completes their reservation by indicating their contact details, online payment being mandatory.
The reservation will be considered validated only upon receipt of an SMS to the indicated number or a validation email sent by the email address automatically sent. If the client does not receive these confirmations within 48 hours, they are invited to contact 'Alexandra Massages Energisants' by phone.
Whether for reservations by phone or internet, an email or SMS will be sent to the number indicated during the reservation 24 hours before the appointment summarizing the service, the time of the appointment and the address of the massage room and asking the client to confirm their presence.
The client agrees to confirm their presence by replying to the text as soon as possible.
In order to organize the schedule, the online reservation is open until 1 working day before. Last-minute appointments will be made only by phone depending on the remaining availability.
6-2- The payment:
For reservations on the website, the total payment of the session is made online via the website.
For telephone reservations, payment can be made at home by cash or credit card.
Checks are not accepted.

6-3- The conditions for modifying and canceling a session:
The client has the possibility to modify their reservation free of charge until 12 hours before the appointment by phone or via their booking email. Beyond this deadline, penalties will apply.
The service will be considered due if the client does not show up on the day of the session. No refund will be made.
Due to several booking abuses not honored:
Any absence from an appointment without prior notice will incur a fee for your no-show.
You have up to 12 hours before your appointment to change your slot or cancel it, in order to avoid cancellation fees.
6-4- Delay management:
The appointment scheduling by «Alexandra Massages Energisants» is carried out in such a way as not to be delayed. A time is planned between each massage that allows to welcome the next client in the best possible conditions.
The client is asked to arrive at the time indicated when making an appointment. If the client arrives late, the session may be shortened to avoid penalizing the next client.
6-5- Booking conditions for the GEOBIOLOGIE:
The reservation for a GEOBIOLOGIE service is organized maximum 48 hours before the date of intervention. For each intervention, a quote is drawn up and must be signed by the client.
The payment of a deposit of 200 euros is mandatory for an appointment, apart from these cases any appointment will be impossible. The deposit can be paid by bank transfer; by credit card or in cash, and will be cashed as soon as it is deposited.
The payment for GEOBIOLOGIE’s service will be mandatory on the day of the intervention, after the end of the energy work.
The payment must be made by bank transfer; in cash or by credit card. Payment by check is not accepted.
Travel expenses are included in the rates displayed on the showcase of the website www.alexandramassagesenergisants.fr, with less than 1 hour’s drive to VAISON-LA-ROMAINE for the planned intervention.
Additional travel costs are charged beyond 1 hour of driving (aisle journey) - which is 15 euros per additional hour.
Beyond 2 hours drive (driveway journey) - the supplement will be charged 30 euros per hour.
6-6- Booking conditions for SHIATSU ANIMAL:
The intervention at the request of a client for an equine shiatsu engages an organization by phone.
If the distance exceeds 45 minutes of driving (outside the areas noted on the website window), the intervention for equine shiatsu must be organized with several appointments in the same sector, or the client commits to paying additional travel costs, is 15 euros per hour of travel.
The payment must be made by bank transfer; in cash or by credit card. Payment by check is not accepted.
For animals (horses and dogs):
- For horses, in case of aggressive and "biting" behavior, the owner undertakes to declare before any appointment the issue in question. The owner is criminally responsible for any injury incurred as a result of the bite of his animal.
During the intervention, the owner must remain on site during the session and close to his horse. In case of "biting" and/or aggressive horses, the owner must set up a facility so that the horse cannot run away and/or bite.
- For dogs, in case of aggressive and "biting" behavior, the owner undertakes to declare before any appointment the issue in question. The owner is criminally responsible for any injury incurred as a result of the bite of his animal.
During the intervention, the owner must remain on site during the session and close to his dog. In case of a "biting" and/or aggressive dog, the owner must implement the wearing of a muzzle.
Wearing a muzzle is MANDATORY for category 1 and 2 dogs.
In case of doubt, the speaker «Alexandra Massages Energisants» reserves the right to install a muzzle adapted to the animal in order to proceed with the canine shiatsu session.
The booking of a dog shiatsu session automatically authorizes the muzzling by "Alexandra Massages Energisants", in which case the session will not take place.
6-7- Booking conditions for the pack ACUPUNCTURE CHIAPI:
The proposed packs must be paid in integralities from the first appointment. In which case, the advantageous pricing cannot be applied to the buyer.
The purchase of a Pack of 3 Chiapi acupuncture sessions is only valid for 6 months, the start date being that of the purchase of the pack. Beyond this deadline, the remaining number of sessions will neither be reimbursed nor carried out.
Once a pack has been purchased, its refund is not possible as soon as it has completed 1 session, the client accepts the general conditions of sale provided on behalf of the company "Alexandra Massages Energisants".
9- THE PURCHASE OF GIFT CARDS AND THE RESERVATION, MODIFICATION OR CANCELLATION OF THE RESERVATION BY THE BENEFICIARY
9-1- The purchase of gift cards
The purchase of gift cards is made at the client’s home or on the website www.alexandramassagesenergisants.fr.
The client has the choice among all the formulas present on the massage card. A gift card in cardboard format will be given to the client. The payment will be made in cash or by credit card.
The purchase of a gift card on the website is available 24 hours a day. To order, the customer chooses the amount they wish to offer and the electronic card will be sent to them by email.
If the customer chooses an electronic gift card:
Payment by credit card will be the only option.
A withdrawal period of 14 working days from the receipt of the customer’s payment is provided without justification or penalty.
"Alexandra Massages Energisants" will refund the amounts paid by the client within a maximum period of 30 (thirty) days from the date of the refund request.
9-2- Terms of gift cards:
All gift cards are numbered, personal and non-transferable. The end of validity date is indicated on the gift card.
Unless otherwise stated, gift cards are valid for 3 months from the date of purchase. They do not give rise to any refund or extension of the validity period, except in the case where I cannot provide the service or medical reason (on justification).
Gift cards will not be replaced or refunded in case of loss or theft.
All expired gift cards will be systematically refused.
10- INABILITY TO WORK
In case of temporary physical disability, due to illness or accident of Alexandra MICELI, «Alexandra Massages Energisants» reserves the right to reschedule new intervention dates in consultation with the client without it being possible for the latter to require payment of compensation. In case of permanent physical incapacity of the practitioner, any type of contract or commitment with the clients of «Alexandra Massages Energisants» will be terminated by right without it being possible to claim from «Alexandra Massages Energisants» a compensatory indemnity. The installments received will be returned to the client within a maximum period of 8 (eight) days following the termination of the contract.
11- APPLICABLE LAW AND COMPETENT JURISDICTION
These GCS are subject to French legislation. In case of disputes, the parties undertake to seek an amicable solution before any legal action. Failing this, any difference arising with a customer having the status of merchant and which would be related to the interpretation, execution or validity of these GTCS will be subject to the exclusive jurisdiction of the courts of Toulon. For all other clients, the provisions of the code of civil procedure will apply.
12- INTELLECTUAL PROPERTY
Alexandra MICELI is the owner of the intellectual property rights over all the elements present visible on the site www.alexandramassagesenergisants.fr, notably: the texts, images, photos, graphics, logo. Alexandra MICELI is also the owner of the intellectual property rights of the brand «Alexandra Massages Energisants».
Any reproduction, representation, modification, publication, adaptation or exploitation of all or part of the brand «Alexandra Massages Energisants» or other elements of the site www.alexandramassagesenergisants.fr is prohibited in any medium whatsoever and in any manner whatsoever except with written agreement from Alexandra MICELI.

13- PROFESSIONAL LIABILITY
Alexandra MICELI has subscribed to an insurance policy for professional liability and operating risks with a well-known company.
It is specified that Alexandra MICELI cannot be held liable in the event of damages related to a client’s negligence, in particular if they have not revealed to Alexandra MICELI the existence of contraindications affecting them, whether during the interview of the first session aimed at alerting him to applicable contraindications, or subsequent appointments in case of changes in his personal health status – See all the contraindications in point 4.
